When is Guardianship Necessary?
Guardianship is a legal tool used in several specific life transitions:
Aging Loved Ones: If an adult family member becomes incapacitated due to illness or cognitive decline, and they can no longer manage their own affairs.
Special Needs Planning: When a child with a disability turns 18, parents may need to establish guardianship to continue making medical and financial decisions on their behalf.
Minor Children & Inheritances: If a minor child inherits a significant sum (over the statutory threshold) or receives a personal injury settlement, the court requires a "Guardianship of the Estate" to protect those funds until they reach adulthood.
Mental or Physical Illness: In cases of temporary crisis, a Limited Guardianship can provide necessary support while allowing the individual to retain as much independence as possible.
